This Privacy Policy describes how Tick & Tock, LLC, a Maryland limited liability company, doing business as Second Tick Co. (“Second Tick Co.,” “Second Tick,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information when you visit or use the Second Tick Co. website and online storefront, purchase products from us, create or use an account, sign up for marketing communications, communicate with us, interact with our chat features, or otherwise use our online services (collectively, the “Services”).

Our online storefront is powered by Shopify, which provides ecommerce, hosting, checkout, payment, security, analytics, customer privacy, communication, and other technologies that help us provide the Services. We may also use other service providers and technologies in operating the Services.

If there is a conflict between our Terms of Service and this Privacy Policy concerning the collection, use, processing, or disclosure of personal information, this Privacy Policy controls with respect to that subject.

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have received and had an opportunity to review this Privacy Policy.

Second Tick Co. may receive transaction confirmations, transaction identifiers, limited payment-method information, billing information, fraud indicators, payment status, and similar information necessary to administer a transaction.

Second Tick Co. does not necessarily receive or store the complete payment-card number or other complete payment credentials entered during checkout.

Account Information

If customer accounts are available and you choose to create one, we may process information such as:

  • your account identifier;
  • contact information;
  • order history;
  • preferences and settings; and
  • other information associated with your account.

Authentication credentials and related account information may be processed or maintained by Shopify or another technology provider.

Marketing and Newsletter Information

If you voluntarily provide your email address through our newsletter sign-up box, promotional form, or similar feature, we collect that email address for marketing and promotional purposes.

We may also maintain information concerning:

  • when you subscribed;

Signing up for marketing communications is voluntary and is not required to make a purchase.

Shopify Inbox and AI Chat Information

Second Tick Co. uses Shopify Inbox, including AI-powered chat functionality, to communicate with customers, provide customer support, answer questions, assist with product discovery, and help customers navigate products and policies.

We may refer to our storefront AI assistant as “Tick.”

When you interact with Tick or another Shopify Inbox chat feature, Shopify and Second Tick Co. may collect and process:

  • messages;
  • prompts;
  • questions;
  • information you voluntarily enter into the chat;
  • information relating to the conversation;
  • session information;
  • technical or device information; and
  • other information reasonably necessary to operate, secure, personalize, improve, or troubleshoot the chat service.

The Shopify Inbox AI agent may use information from our product catalog, policies, knowledge-base materials, storefront content, and other Second Tick Co. information to generate responses.

If you are signed into or otherwise interacting through Shopify or Shop services, Shopify may also use information available through those services to provide functionality or personalize your experience where permitted.

Please do not provide passwords, complete payment-card numbers, Social Security numbers, government identification numbers, medical information, or other highly sensitive information through Tick or another chat feature unless specifically requested through an appropriate secure process.

Device and Technical Information

When you use the Services, we and our service providers may automatically collect information such as:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • device and online identifiers;
  • network information;
  • referring pages;
  • pages or products viewed;
  • approximate location derived from technical information such as an IP address;
  • dates and times of interactions; and
  • information about how you navigate or interact with the Services.

Fraud, Security, and Verification Information

We and our service providers may collect and process information reasonably necessary to:

  • detect fraudulent transactions;
  • verify transactions;
  • investigate suspicious activity;
  • prevent unauthorized use;
  • respond to chargebacks;
  • protect customer accounts;
  • secure the Services; and

  • from Shopify, including through Shopify's ecommerce, checkout, analytics, customer-privacy, fraud-prevention, marketing, Shop, and Shopify Inbox functionality;
  • from payment providers, including payment status, transaction information, fraud indicators, disputes, and chargeback information;
  • from shipping carriers and fulfillment providers, including tracking and delivery information;
  • from analytics, advertising, marketing, or business partners, where we use those services; and
  • from other sources permitted by applicable law.

3. How We Use Personal Information

We may use personal information for the following purposes.

Providing and Operating the Services

We may use information to:

  • operate and maintain the Site;
  • display products;
  • maintain shopping carts;
  • process and administer orders;
  • process payments;
  • arrange shipment and delivery;
  • process returns and refunds;

  • improve the functionality and quality of the chat experience;
  • prevent fraud, abuse, or misuse; and
  • otherwise operate the Services.

AI-generated responses may occasionally be incomplete or inaccurate. Our Terms of Service contain additional terms concerning Tick and other AI-generated features.

Marketing and Newsletter Communications

If you voluntarily subscribe to marketing communications, we may use your email address and related information to send:

  • occasional discounts;
  • holiday deals;
  • special offers;
  • promotional campaigns;
  • product announcements;
  • store updates; and
  • other marketing communications.

We may also use information to understand the effectiveness of our marketing campaigns and communications.

You may unsubscribe from promotional emails at any time using the unsubscribe mechanism contained in the email or another method we make available.

Unsubscribing from promotional communications will not prevent us from sending non-promotional communications reasonably necessary for orders, transactions, accounts, customer service, security, legal notices, or other ongoing interactions.

Blocking cookies may affect certain Services or Site functionality.

Where applicable law requires us or Shopify to recognize an applicable opt-out preference signal, such as Global Privacy Control (“GPC”), that signal will be processed as required by applicable law and the functionality available through our platform.

Other browser-based “Do Not Track” signals may not be recognized unless applicable law requires otherwise.

5. Shopify and Shopify Network Intelligence

Our online storefront is powered by Shopify.

Shopify collects and processes personal information relating to your access to and use of the Services in order to provide ecommerce, checkout, payment, fraud-prevention, security, analytics, personalization, customer communications, and other functionality.

Information submitted through the Services may therefore be transmitted to or processed by Shopify and its service providers.

Shopify Network Intelligence

Shopify Network Intelligence is enabled for our store.

Through Shopify Network Intelligence and related enhanced Shopify services, Shopify may use information concerning your interactions with Second Tick Co. together with information concerning your interactions with Shopify and other Shopify merchants to provide, support, personalize, secure, improve, or measure Shopify services and enhanced features.

These features may include functionality relating to:

  • personalization;
  • analytics;
  • fraud prevention;
  • Shop and Shopify experiences;
  • marketing;
  • advertising; and
  • other Shopify services.

Depending on where you live, certain uses or disclosures involving Shopify Network Intelligence may be considered a “sale,” “sharing,” or processing for “targeted advertising” under applicable privacy laws.

Where applicable, privacy choices may be available through the Data Sharing Opt-Out, Privacy Choices, cookie preferences, or similar controls provided through our Site or Shopify.

Shopify's privacy technology may also process qualifying browser-based signals such as Global Privacy Control where required by applicable law.

Shopify independently maintains privacy policies describing its processing of consumer information and provides mechanisms through which eligible individuals may exercise certain privacy rights directly with Shopify.

6. Shopify Inbox and Tick

We use Shopify Inbox to provide online messaging and customer-support functionality.

Shopify Inbox includes AI-powered functionality that may assist in answering customer questions and providing product or policy information.

We refer to our storefront assistant as Tick.

Messages or prompts submitted through Tick may be processed by Shopify and the technologies Shopify uses to provide its AI-powered services.

Shopify may use artificial-intelligence technologies, including large-language-model technologies, in providing these features. The particular models, technology providers, infrastructure, or methods Shopify uses may change over time.

Second Tick Co. does not control which underlying AI model or technology provider Shopify may use.

Your use of Tick does not require you to provide sensitive personal information, and you should avoid doing so unless specifically directed through an appropriate secure process.

7. How We Disclose Personal Information

We may disclose personal information when reasonably necessary for legitimate business or legal purposes.

Shopify and Technology Providers

We may disclose or make information available to Shopify and other technology providers that host, secure, maintain, support, analyze, or enable the Services.

Payment Providers

Information may be disclosed to or collected directly by:

  • payment processors;
  • banks;
  • payment networks;
  • card issuers;
  • fraud-prevention services; and
  • other providers involved in processing or securing transactions.

Shipping and Fulfillment Providers

Second Tick Co. currently offers direct purchases through its Site to customers in the United States.

However, Shopify and other service providers may maintain infrastructure, personnel, systems, or service providers in other states or countries.
